Arrogant
“The Council is not responsible for maintaining, repairing or clearing YOUR PRIVATE DRAINAGE. It serves no highway drainage or other purpose connected with the Council,” legal head Jonathan Mair (May 2019)
“The Council has done nothing to prevent those who benefit from the PRIVATE DRAINAGE SYSTEM from maintaining, repairing or clearing their (not the Council’s) PRIVATE DRAIN,” Jonathan Mair to my then MP Sir Oliver Letwin (June, 2019).
PERJURY
This was precisely the same misleading drivel Dorset Council fed to the Ombudsman some years earlier and they completely swallowed it.
Quoting the Ombudsman’s original report…..”The Council said what it had done to ascertain the condition and location of the drainage systems close to Mr Chisholm’s home and had ensured the outfall of the private system was clear and working as it should.”

“We have given Mr Chisholm permission to enter on to the land to make periodic inspections of the ditch and provided him with a list of insurers, who specialise in insuring properties with a history of flooding,” Ben Lancaster (Rural practise manager) letter to Sir Oliver (March, 2019). There was no insurers list and no history of flooding.
RIPARIAN LAW STATES LANDOWNERS MUST ENSURE WATER COURSES RUN FREELY . IF A FLOOD HAPPENS AS A RESULT OF A LANDOWNER NOT CARRYING OUT THEIR RIPARIAN RESPONSIBILITIES TO PROPERLY MAINTAIN A WATERCOURSE THAT LANDOWNER COULD BE LIABLE FOR COMPENSATION.
Plan for DT9 4JY
IT COULD NOT BE CLEARER
1, Dye being poured down the highways gully (C).
2, Dye emerging from pipe (A) – the discharge Council claim is my private drainage system
3, The mud and gravel being flushed into (C)
4, The gradual accumulation at (A) that causes blockages
5, Huge amount of mud etc that encased (A) at the time of floods.
6, Sand bags at my back door when water backed up through the system and up through my patio gully.
7, A lone highways gully (B) with Hayward Cottage in the background.
8, Exit pipe serving (B) which Council claim is discharge for the entire system!
The report of Dorchester Drainage company; “we dye tested your drain and it proved your surface water travels out to the highway drainage ditch via the highway drain”. Unless remedial action is carried out there is high risk of the water rising through the pipework into your garden, as has previously happened.”
